SAMPLE ADOPTION AGREEMENT

This donation contributes towards the veterinary care received by your Rescue Animal in Aruba, as well as their travel expenses to the United States. This donation may be tax-deductible, please check with your financial advisor.

The prospective adopter agrees to the following terms and conditions:

Adopter is 25 years or older and legally permitted to enter into this agreement.

Adopter will not gift, sell, or trade the Rescue Animal to any other entity. Adopter will not advertise the Rescue Animal on any social media platforms or classified websites (e.g. Craigslist) with intent to rehome, sell, or trade.

Adopter will not abandon nor surrender the Rescue Animal to a shelter. In the event the Adopter can no longer properly care for the Rescue Animal, the Adopter must immediately notify New Life for Paws Foundation. The Foundation will work with the Adopter to rehome the Rescue Animal if the following conditions are met:

  • The Rescue Animal is up-to-date on vaccinations and preventative medications

  • The Rescue Animal is spayed/neutered (if older than 6 months)

  • Adopter has proof of attending/participating in group/one-on-one training lessons

  • Adopter provides a behavioral assessment of the Rescue Animal written by a professional dog trainer

  • Adopter understands that New Life for Paws cannot guarantee success in finding the Rescue Animal a new home, nor can New Life for Paws guarantee meeting Adopter’s relinquish deadline.

If any behavioral problems have occurred before Adopter returns the Rescue Animal, the Adopter agrees to pay for a professional trainer’s evaluation in case of biting or aggression.

The adopter resides in a dwelling that permits Rescue Animal and acknowledges this adoption will not be in violation of any existing residential agreement.

Rescue Animal will be treated as an Adopter’s family member with loving care and affection, and Adopter agrees to do their best to ensure Rescue Animal’s safety, health, and overall well-being. This includes – but is not limited to – providing enough nutritious food and clean water each day.

Rescue Animal will not be subject to any physical, mental, or emotional abuse, and will live inside Adopter’s home as a companion animal only.

Rescue Animal well be kept current on flea and heartworm preventives, rabies and distemper vaccinations, and provided with necessary veterinary care upon sickness, disease, or injury.

Adopter agrees to comply with their local and state laws regarding sterilization, proper licensing, and personal identification tags of Rescue Animal.

If applicable, Adopter will have Rescue Animal spayed/neutered no later than what is recommended by a licensed veterinarian and will forward proof upon request by New Life for Paws Foundation.

Adopter affirms that no member of their household has been convicted of an animal welfare law violation.

Adopter will not use a choke-type collar, except for training under the guidance of a qualified dog trainer.

Adopter agrees to accept responsibility and ownership of Rescue Animal at their own risk and Adopter releases New Life for Paws Foundation and its agents from all liability arising out of possession and ownership of Rescue Animal. Adopter agrees to assume total financial responsibility for Rescue Animal as of the date of this contract. New Life for Paws and its agents will not be held responsible for any damages or expenses (veterinary or other) incurred during Adopter’s ownership of Rescue Animal.

If the Rescue Animal becomes lost or dies, Adopter will immediately notify Aruba Flight Volunteers. Adopter will also immediately notify New Life for Paws Foundation of any change in contact information (i.e., address, phone number, or email).

Rescue Animal’s known background and medical history have been discussed with Adopter. Adopter understands that New Life for Paws has made no representation concerning the health, condition, training, behavior, or temperament of Rescue Animal.

Adopter agrees to permit New Life for Paws Foundation to make inquiries about and enforce any of the above terms and conditions after adoption. This can include visits to Adopter’s home and contact with the veterinarian. Adopter understands that failure to comply with any of the above provisions will result in forfeiture of Rescue Animal to New Life for Paws Foundation.

Adopter understands that by voluntarily signing this agreement, Adopter is entering into a legal and binding contract with Aruba Flight Volunteers. Breach of any term(s) of this agreement is deemed actionable by New Life for Paws Foundation. In the event there is a violation of the agreement, Adopter agrees to pay a minimum of $1,000.00 in damages. Additionally, to facilitate the collection of damages for breach of contract, Adopter waives any challenge to the venue and agrees that the appropriate venue for this matter is the State of New York and the County of Putnam. Furthermore, Adopter agrees to accept service of process by certified mail, return receipt requested, to the address provided in this adoption contract, and specifically waive any right to receive personal service.

 A nonrefundable donation of $550 will be paid on the day of adoption. This donation contributes towards the veterinary care received by your Rescue Animal in Aruba, as well as their travel expenses to the United States.
